歡迎使用順風 Fairwind（下稱「本服務」）。本條款是您與我們之間的法律協議。使用本服務即代表您接受本條款。若您不同意本條款的任何部份，請勿使用本服務。
Welcome to Fairwind 順風 ("the Service"). These Terms form a legal agreement between you and us. By using the Service, you accept these Terms. If you disagree with any part, do not use the Service.

1. 服務內容 · Service Description

本服務是一個基於紫微斗數命盤生成 AI 命理內容的網絡應用程式。您可以：
The Service is a web app that generates AI-written content based on Zi Wei Dou Shu (紫微斗數) astrology charts. You may:

• 輸入命主出生資料以計算命盤
  Submit profile birth data to compute a chart
• 購買／使用點數兌換命批（大批、十年、流年、每日運程、主題小批等）
  Purchase / spend points to redeem readings (lifetime, decade, annual, monthly daily, theme focus)
• 開啟每日運程的自動續月訂閱
  Activate monthly auto-renew for the Daily Forecast
• 送禮券予親友、邀請親友獲得獎勵
  Send gift vouchers to friends and earn invite-code rewards

⚠️ 本服務僅供娛樂及自我反思用途。命批內容並非：
⚠️ The Service is for entertainment and self-reflection only. Reading content is not:

• 醫療、心理治療或健康建議
  Medical, psychological, or health advice
• 投資、財務或稅務建議
  Investment, financial, or tax advice
• 法律建議
  Legal advice
• 任何受監管之專業意見
  Any form of regulated professional opinion

For medical, financial, or legal matters, consult a licensed professional.

2. 資格 · Eligibility

• 使用本服務您必須年滿 13 歲
  You must be at least 13 years old
• 13 至 18 歲用戶須得到家長／監護人同意
  Users aged 13 to 18 must have parental / guardian consent
• 您必須具備訂立法律有效合約之能力
  You must be able to enter into legally binding contracts
• 您必須遵守您居住地／使用地之相關法律
  You must comply with the laws of your residence and use locations

3. 帳戶 · Account

• 您可透過第三方身份驗證服務（如 Google、Microsoft）或電郵驗證碼註冊帳戶
  You may register via a third-party authentication provider (e.g., Google, Microsoft) or by email verification code
• 您有責任維護您帳戶之安全（包括相關第三方帳戶）
  You are responsible for the security of your account (including any linked third-party accounts)
• 帳戶內所有活動均由您本人負責
  You are responsible for all activity under your account
• 如發現未經授權的使用，請即時聯絡我們
  Notify us immediately of any unauthorised use

4. 命主資料之準確性 · Profile Data Accuracy

• 您確認所填入之命主資料（姓名、出生日期、出生時間、性別）正確
  You confirm that the profile data you submit (name, DOB, birth time, gender) is correct
• 紫微命批是根據此等資料計算。資料不準確將直接影響命批內容之準確性，我們不為此負責
  紫微 reading is computed from this data. Inaccurate data directly affects reading quality. We are not responsible for inaccuracy caused by user-supplied data
• 如發現資料錯誤，您可於命主頁面申請修改
  If you spot an error, request a correction on the profile page

5. 點數錢包與付款 · Points Wallet and Payments

5.1 點數機制 · Points Mechanic

• 1 點 = HK$1（預設按用量付費）
  1 point = HK$1 (pay-as-you-go default)
• 您可透過以下途徑取得點數：
  You can obtain points through:
  • 自由充值（最少 HK$100）
    Custom topup (minimum HK$100)
  • 購買套裝商品
    Purchasing bundled packages
  • 收受朋友送出之禮券
    Receiving gift vouchers
  • 邀請碼獎勵
    Invite-code rewards
• 點數永久有效，不會過期
  Points never expire

5.2 付款處理 · Payment Processing

• 所有付款透過 Stripe 處理。Stripe 之服務條款適用於付款流程
  All payments are processed by Stripe. Stripe's terms apply to the payment flow
• 我們接受 Stripe 所支援之付款方式（信用卡、Apple Pay、Google Pay、支付寶、微信支付等）
  We accept payment methods supported by Stripe (cards, Apple Pay, Google Pay, Alipay, WeChat Pay, etc.)
• 所有價格以**港幣（HKD）**顯示，含稅（如適用）
  All prices in HKD, inclusive of tax where applicable

6. 退款政策 · Refund Policy

7. 禮券、邀請碼、獎勵 · Vouchers, Invite Codes, Rewards

7.1 禮券（送禮） · Gift Vouchers

• 禮券屬不記名憑證 — 任何持有兌換碼之人均可兌換
  Vouchers are bearer instruments — anyone with the redemption code can claim
• 請妥善保管兌換碼
  Keep your codes private
• 禮券永不過期
  Vouchers never expire
• 不可以將已生成之禮券轉售予第三方以換取金錢
  You may not resell generated vouchers to third parties for cash

7.2 邀請碼／推薦獎勵 · Invite Codes / Referral Rewards

• 每個帳戶持有唯一邀請碼，可與朋友分享
  Each account has a unique invite code to share with friends
• 當朋友單次購買 ≥ HK$88 並首次填入您的邀請碼，雙方各獲得 88 點
  When a friend purchases ≥ HK$88 in a single transaction and uses your invite code for the first time, both sides receive 88 points
• 每個帳戶只可使用一次邀請碼（終身上限）
  Each account can use an invite code only once (lifetime cap)
• 不可以使用自己之邀請碼
  Cannot use your own invite code
• 以機器人／大量假帳戶濫用邀請碼系統，將導致帳戶永久封鎖、點數沒收
  Bot / multi-account abuse of the referral system results in permanent account ban and forfeiture of points

8. 可接受使用 · Acceptable Use

您不可以：
You may not:

• 嘗試逆向工程、反編譯、爬取本服務
  Reverse engineer, decompile, or scrape the Service
• 自動化大量呼叫 API（如 DDoS 攻擊、機械人濫用）
  Automate bulk API calls (DDoS, bot abuse)
• 將命批內容轉售或再分發予第三方作商業用途
  Resell or redistribute reading content commercially
• 利用本服務生成違法、誤導、誹謗、騷擾性內容
  Use the Service to generate illegal, misleading, defamatory, or harassing content
• 偽造他人身份或冒充本服務工作人員
  Impersonate others or Service staff
• 嘗試破解／繞過本服務之安全機制
  Attempt to circumvent security mechanisms
• 利用本服務之錯誤或漏洞獲取額外點數／內容
  Exploit bugs or vulnerabilities for additional points / content

違反以上條款，我們有權立即暫停或終止您的帳戶，並追究法律責任。
Violation results in immediate suspension or termination plus possible legal action.

9. 智慧財產權 · Intellectual Property

• 本服務之原始碼、設計、品牌、商標屬我們所有
  The Service's source code, design, brand, and trademarks are our property
• AI 生成之命批內容版權歸屬：您獲得個人使用之永久授權，但不可以作商業性分發（轉售、出版、用於訓練模型）
  AI-generated reading content: you receive a perpetual personal-use licence, but cannot redistribute it commercially (resell, publish, use for model training)
• 您所提交之命主資料及內容歸您所有，但您授權我們以生成命批、改善服務之技術用途處理該等資料
  Profile data and content you submit remain yours; you grant us a licence to process this data for generating readings and improving the Service

10. 免責聲明 · Disclaimers

• 「按現狀」提供（AS-IS）：本服務按現有狀態提供，不作任何明示或默示之保證
  AS-IS — the Service is provided as-is, without express or implied warranty
• 不保證內容之準確性、完整性、實用性
  We do not guarantee accuracy, completeness, or usefulness of content
• 不保證服務不會中斷、無錯誤、無安全漏洞
  We do not guarantee uninterrupted, bug-free, or secure operation
• 紫微斗數結合傳統文化與概率推算，並非決定性預言。您不應將任何命批內容作為唯一決策依據
  紫微 is traditional culture + probabilistic inference, not deterministic prophecy. You should not rely solely on reading content for any decision

11. 責任限制 · Limitation of Liability

於法律容許之最大範圍內：
To the extent permitted by law:

• 我們對您之責任上限為您過去 12 個月支付予本服務之總金額
  Our liability to you is capped at the amount you paid the Service in the past 12 months
• 我們不對間接、附帶、特殊、後續、懲罰性損害負責（包括但不限於利潤損失、業務中斷、資料損失）
  We are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, business interruption, data loss)
• 部份司法管轄區不容許責任排除，本條款於該等地區僅適用於法律容許之範圍
  Some jurisdictions disallow liability exclusion. There, these terms apply only to the extent permitted

12. 帳戶終止 · Account Termination

我們可能於以下情況暫停／終止您的帳戶：
We may suspend / terminate your account if:

• 您違反本條款
  You breach these Terms
• 法律或法定機關要求
  Required by law or authority
• 本服務終止運作
  Service is discontinued

帳戶終止後：
After termination:

• 未使用之點數將會喪失（除非因我們終止服務所引致）
  Unused points are forfeited (except where we terminate the Service ourselves)
• 您的資料將依私隱政策第 4 節之保留期處理
  Your data is processed per Privacy Policy §4 retention

如您欲自願結束帳戶，請電郵申請。
To voluntarily close your account, email us.

13. 適用法律 · Governing Law

本條款受香港特別行政區法律規管。任何爭議由香港法院專屬管轄。
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Disputes are submitted exclusively to Hong Kong courts.

14. 條款更新 · Terms Updates

我們可能會不時更新本條款。重大更新（例如改變付款條款、新增限制）會於生效前 14 日經電郵通知您；輕微更新將直接更新本頁面。生效日後繼續使用本服務即代表您接受新條款。
We may update these Terms from time to time. Material changes (payment terms, new restrictions) will be notified by email 14 days before the effective date; minor updates apply directly. Continued use after the effective date constitutes acceptance.
